A range of different structures are available for property portfolios or the like. Advise is given on a case by case basis, and is dependent on the client’s business model or circumstances. For example, a client who trades property will receive different advice than a client who invests in property for long term yields.
We recommend having a written contract regardless of the value of the building work. However, as of 1 August 2017, the Law is that you must have a written ‘major domestic building contract’ for work worth more than $10,000. The contract must meet the requirements of the Domestic Building Contracts Act 1995 (VIC).
It is possible for you to withdraw from the Domestic Building Contract within five business days after receiving a signed copy of the contract. The cooling off period starts from the date you receive the executed copy of the building contract.
You do not enjoy the benefit of a cooling off period in the following instances:
- You previously entered into a major domestic building contract with the builder on the same terms for the property;
- hired a lawyer to review the contract before signing the contract.
To cool off, you must serve a written notice to the Builder in accordance with the terms stated in the Building Contract. However, it is essential that the builder is served a correct notice and within the time. Please feel free to call us before the expiry of the cooling off period so as to make sure that the notice is given in complete compliance with the terms of the contract.
It depends on the websites. Some websites, such as the court websites and the like, make available certain documents. However, other websites, such as a law firm’s website may have certain documents uploaded available for download, however those documents could possibly be out dated. Therefore, it is essential to have a lawyer so as to make sure that you have correct advise and information.
